"Client," "You," or "Your" refers to the individual, business, or entity entering into an agreement with DE' DESIGNFOLIO for the provision of our services. The term "Website" refers to DE' DESIGNFOLIO’s official website, including all of its content, services, and features provided online. "Services" encompass all offerings by DE' DESIGNFOLIO, including but not limited to web design, digital marketing, digital photography, and artificial intelligence solutions.

Scope of Services

The services provided by DE' DESIGNFOLIO include web designing, digital marketing strategies, digital photography, and artificial intelligence-driven solutions tailored to meet the specific needs of our clients. We reserve the right to refuse service, cancel projects, or terminate agreements if a client fails to comply with these terms or engages in activities that are unlawful or detrimental to our reputation and interests.

Payment Terms

All payments for services must be made according to the terms outlined in the respective proposal or contract. Depending on the nature of the project, payments may be required upfront or according to a milestone payment schedule, which will be detailed in the service agreement. In situations where payments are delayed or remain unpaid beyond the due date, DE' DESIGNFOLIO reserves the right to suspend or terminate services until all outstanding amounts are settled. Please note that once a project has commenced, all fees are non-refundable, except in cases where a specific refund policy is mentioned in the contract or a mutual agreement is reached between both parties.

Intellectual Property Rights

All content, designs, code, and deliverables created by DE' DESIGNFOLIO during the course of a project remain the property of the company until the client has made full payment as stipulated in the agreement. Upon receiving the final payment, the intellectual property rights for custom designs, websites, and specified deliverables will transfer to the client, excluding any third-party tools or software used in the project. However, DE' DESIGNFOLIO retains the right to showcase the completed work in our portfolio for marketing and demonstration purposes unless specifically agreed otherwise in writing.

Client Obligations

The client is expected to provide timely access to all necessary content, images, logos, and information required to complete the project as outlined in the agreement. Any delays in providing required materials, approvals, or feedback may result in timeline adjustments and potential additional charges. It is the client’s responsibility to review and approve all materials, designs, and content before project completion. Once the project is approved, any subsequent changes will be billed at our standard hourly rates.

Revisions and Modifications

Minor revisions are included within the initial scope of work as defined in the agreement. However, additional or major changes beyond the agreed scope will be charged separately at our standard hourly rate. Any requests for revisions must be submitted in writing and approved by both parties to ensure a clear direction and avoid misunderstandings during the project’s development phase.

Cancellation and Termination

Both parties have the right to terminate a project with a 14-day written notice. If the client decides to cancel the project before its completion, the client will be responsible for paying for all work completed up to the cancellation date, including any costs incurred during that period. DE' DESIGNFOLIO also reserves the right to terminate a project if the client breaches these terms, fails to communicate effectively, or engages in unethical or inappropriate behavior.

Use of Third-Party Services and Tools

DE' DESIGNFOLIO may use third-party tools, plugins, or software for web design, marketing, or AI services. The use of these tools is governed by the terms and conditions of the respective third-party providers. While we strive to choose reliable third-party services, DE' DESIGNFOLIO is not responsible for any disruptions, issues, or limitations caused by these third-party tools that may impact the progress or quality of the project.

Security Information

Your information stored by DE' DESIGNFOLIO is entirely protected by using industry-standard security measures. All the information is protected and secured with firewalls and encrypted protocols. This practice is maintained to stop any unauthorized access to our valuable data. Our meticulously developed security system secures your information from being misused or alteration. Highly sensitive data like credit card information is highly protected through secure socket layer (SSL). This system delivers encryption during the process. Our professionals are trained to protect your data. Both external and internal resources are revised for the capability of our security process.

Disclaimers

We do not guarantee that our services will meet your expectations or that they will be uninterrupted, timely, or error-free. All services provided by DE' DESIGNFOLIO are offered "as is" without any express or implied warranty unless explicitly stated otherwise in a separate agreement. Any reliance you place on the information provided on our website or through consultations is strictly at your own risk, and DE' DESIGNFOLIO disclaims all liability for any decisions or actions taken based on this information.

Confidentiality

Both parties agree to maintain the confidentiality of proprietary or sensitive information shared during the course of the project. This includes, but is not limited to, business strategies, financial data, client data, designs, and proprietary information. The obligation to maintain confidentiality will survive even after the termination or completion of the project.

Dispute Resolution

In the event of a dispute arising from these Terms and Conditions or the services provided, both parties agree to attempt to resolve the issue amicably through direct negotiation. If a resolution cannot be reached, disputes will be settled by binding arbitration in accordance with the laws of Pakistan. Any legal actions or proceedings related to our services must be brought exclusively in the courts of Pakistan.

Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of Pakistan. By using our services, you agree that any disputes arising out of or related to these terms will be subject to the exclusive jurisdiction of the courts in Pakistan.
